Registration and Enforcement of IP Rights in Korea: A Brief Introduction (Part 2)
2007-08-09 13:53:03
[Editor’s Note: We continue from Part I)]
Basic Overview of IP Enforcement Mechanisms
The first thing I can say about enforcing your IP in Korea is “forget civil courts and damages.” Such cases can be long, expensive, long, tedious, long, and can have anticlimactic rulings (oh, did I mention they were long?). For the latter, courts usually only award compensatory damages that can be meticulously accounted for and they almost never give punitive damages. To give you a time frame, an initial decision can take at least a year, and usually you can add another year or so for the appeals process to work out, and the latter makes the reward for patience rarely worth it. To make these options even more unattractive, while you may be able to recover legal fees, they are limited by law and rarely match the actual cost.
However, I actually should not be so dismissive. Civil courts can be a weapon in your arsenal. You will find your Korean lawyers treat it as a weapon of last resort. ...

Even More Real Estate Regulations in the Pipeline
2007-08-09 11:28:26
Further to my post last week More Real Estate Hurdles Coming Soon for Investor in China, comes the even more ominous China Daily story China tightens rules on foreign property investors.
According to the article:
China is tightening its grip once more on foreign investors in Chinese real estate, banning them from borrowing offshore in the latest effort to tame property prices and cool the economy.
The new rule, set out in a circular from the State Administration of Foreign Exchange , could squeeze foreign investors who take advantage of lower interest rates outside China.
18 months ago, I actually was working on a case that had offshore structure and financing, and through low interest loans in the States, and the appreciating RMB, the client was looking at not only a RMB appreciation that would offset the interest payments, their leveraged return was significantly higher than if they had leveraged in China. This was a result of interest rates in the U.S. being lower than in China, ...

Consumption Per GDP Unit Down 2.78%
2007-08-09 06:09:42
China cut its energy consumption per unit of gross domestic product by 2.78% on year in the first half of this year, improving on its full-year pace last year. Given the nation’s rapid GDP growth, however, the cut didn’t suggest its total energy use declined, but rather grew slightly slower than its 11.5% GDP growth in the first half. Chevron’s bid was chosen over those of Statoil ASA of Norway, France’s Total SA and Anglo-Dutch oil giant Royal Dutch Shell PLC, the people said. Read Original Post Here

Mattel’s Woes Raise Questions of Responsibility
2007-08-09 06:09:41
Mattel Inc.’s recall of nearly one million toys raises questions about the role Western companies should play in monitoring the complex supply chain linking them to low-cost production facilities in China. China makes nearly 80% of the toys shipped into the U.S. and is a leading exporter of products from electronics to apparel to auto parts. Read Original Post Here

Exports Expected to Cool on Tax Change, Not Recalls
2007-08-09 06:09:40
China’s export juggernaut is likely to show signs of slowing, but the shift will come from a change in tax policy rather than from mounting concerns about the safety of Chinese goods, economists say. The slowdown comes amid scandals involving safety problems with food and other products, which have triggered recalls around the world. Read Original Post Here
