It happened around 1am at the intersection FM 2665 and Highway 59 northeast of Shepherd in Polk County."There is alcohol containers on the scene," said David Gustafson withthe Department of Public Safety. "However we do not know if theoccupants of the vehicle had been consuming any alcohol at this time."DPS troopers tell us the big-rig truck T-boned the pick-up, after thesmaller vehicle pulled in front of the 18-wheeler. Three people in thepick-up were killed. A fourth person was taken to a hospital by LifeFlight. The driver in the big truck was not hurt. Court casts doubt on DUI test

PEORIA, Ill., Oct. 10 (UPI) -- An IllinoisSupreme Court ruling could make it harder for prosecutors to use fieldsobriety test evidence to prosecute alleged drunken driving. The court ruled recently that Peoria County JudgeJerelyn Maher improperly allowed the results of a horizontal gazenystagmus (HGN) test to be used in a drunken driving trial withoutfirst hearing testimony as to whether the test passes scientificmuster, the Peoria Journal Star said Wednesday. The HGN test checks tosee if a person can follow a pen or a finger smoothly. Michael Rickgauer, the attorney who filed theappeal, said the test's methodology is subjective because there is noway to quantify the results . source ...

Graduate student suspended after e-mail supporting gun rights

Now this just aint right.....A Minnesota university has suspended one of its graduate students whosent two e-mail messages to school officials supporting gun rights. Hamline University also said that master's student Troy Scheffler, whoowns a firearm, would be barred from campus and must receive amandatory "mental health evaluation" after he sent an e-mail messagearguing that law-abiding students should be able to carry firearms oncampus for self-defense. Hamline spokesman Jacqueline Getty declined on Wednesday to answerquestions about the suspension, saying that federal privacy lawsprohibited the school from commenting. a little to add from the last post.....As the Illinois House prepares to debate amotion to override the governor’s veto of legislation to adopt auniform speed limit on Illinois rural interstate highways, USDOTstatistics show that those states that have adopted a uniform 65 mphspeed limit have had a lower fatality rate over the last 10 years thanIllinois, according to a Mid-West Truckers Assoc. Well some did for awhile......A Melbourne truck drivingschool owner accused of using improper commercial driver's licensetesting procedures could face prison time after his rejection from anearly resolution program that would have allowed him to avoid trial. oseph Neal Smith, 51, ischarged with 13 felony counts of unlawfully agreeing to supply adriver's license to Interstate Trucking Academy students between Dec.7, 2005, and June 7. Each count carries a maximum penalty of five yearsin prison.Prosecutors won't commenton the allegations against Smith, but a Florida Highway Patrol arrestaffidavit alleges the Merritt Island man employed several questionablemethods, including using an unapproved testing route and payingstudents to work at his home or furniture business while giving themcredit for classes they never attended.source ...

Are Mexican trucks safe?

Will these trucks pass a CHP safety examination? Are the trucks up toDepartment of Transportation standards? Would the truck drivers pass aDMV examination for a class A driver's license? Are the drivers given aphysical examination by a doctor prior to licensing? Are the driversgoing to be given random drug/alcohol tests per DOT laws? Will theirloads be examined for contraband? Are they insured? These are all standards that American trucking companies and their drivers have to comply with. Instead Navarrette chose to attack a union and apply his politicaldistortions. I do not believe a country such as Mexico, where policeare openly targeted by drug cartels, is capable of guaranteeing safetrucking. Mexico is not on equal footing with the U.S. If it were, thenmillions would not be fleeing Mexico for the U.S. source ...

FAIRMONT, Minn. - Four boys and an 18-year-old man have been charged inthe case where a someone dropped a bowling ball off an Interstate 90overpass in Minnesota onto the freeway in August, seriously injuring aMontana truck driver.A 17-year-old Fairmont boy was charged with first-, second- andthird-degree felony assault and first-degree criminal damage toproperty, along with conspiracy to commit. He allegedly dropped thebowling ball that hit truck driver 54-year-old trucker Theodore Maki ofMissoula, Montana.Eighteen-year-old Andrew Fellersen of Fairmont told authorities he waswith the boys when they stole a bowling ball off a fence post from abackyard in Fairmont and drove to the overpass.
